Abstract

The 2024 General Election has ended with the election of the President and Vice President. However, history records that there was a legal controversy regarding the nomination of Gibran Rakabuming Raka as vice presidential candidate. Starting with the decision of the Constitutional Court which changed the age limit for candidates for President and Vice President to a minimum of 40 years or experience as a regional head. The controversy raises questions about the existence of dynasties in Indonesia from the perspective of positive law governing general elections. This research is a normative legal research type, with a statutory approach, historis, and a conceptual approach. Sources of legal materials use libraries. Legal analysis uses qualitative descriptive. Research results: dynasties in Indonesia, both political dynasties and political dynasties, in positive law governing general elections do not explicitly prohibit them. The modification of the Constitutional Court's decision regarding the age requirements for Presidential and Vice Presidential candidates is a final and binding decision that does not prohibit the existence of dynasties in Indonesia.
