Abstract

Abstract: A quite horrendous incident in the world of law, especially in the field of land law, where the Ministry of ATR/BPN issued a Decree in the form of a Circular Letter from the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 2/SE-HT.02.01/VI/2019 regarding the granting of HGB (Hak Guna Bangunan) for a Limited Liability Partnership (Commanditaire Vennotschap) on June 28, 2019, one of the contents of which is that CV can submit an Application for Land Rights in the form of Hak Guna Bangunan. This type of research is a normative juridical research. The research technique used in this research is library research. From the results of this study, that the issuance of a Circular regarding the granting of Building Use Rights (HGB) to CV (Commanditaire Vennotschap) caused a conflict of norms against the provisions in Article 36 paragraph (1) of the UUPA jo. Article 19 PP 40/1996 that those who can have land rights with the status of Building Use Rights are Indonesian citizens and Indonesian legal entities. In addition, in the concept, the granting of Building Use Rights to the said nominee is a form of agreement that reflects the private acknowledgment of the companies that land rights belong to CV, where this is prohibited so that there is no legal certainty. If there is a CV that is the subject of a Building Utilization Right holder, then according to Article 36 paragraph (2) of the UUPA the right must be released or transferred within 1 year otherwise the right will be nullified by law
