Abstract

Abstract: Digital media is one part of the development of the field of technology which is experiencing rapid development because along with the times, dependence on digital media is increasingly real and feels especially the use of social media, this is due to technological developments that cannot be separated from human needs that are increasingly open to technology. modernity. Social media as a means and space in conveying thoughts, ideas, ideas and opinions. Freedom of expression is the cornerstone of modern democracy. Law No.19 of 2016 concerning Amendments to Law No. 11 of 2008 concerning Information and Electronic Transactions regulates law enforcement against violations in the use of information technology, Social media in this case indirectly gives freedom to the public to freedom of opinion, but on the other hand it is also a threat to users because there are rules in the ITE Law. considered to be lurking and limiting the freedom of expression. The purpose of this study is to support, analyze, review, interpret and criticize the implementation of the issuance of the Law No. 19 of 2016 Amendments to Law No. 11 of 2008 concerning Electronic Information and Transactions, whether freedom of opinion can be criminalized and whether there are conflict over freedom of expression. This research uses doctrinal law research methods, collecting through literature study by referring to primary and secondary legal materials. Normative Analysis Method. The conclusion of this study is that freedom of expression is a citizen's right that is protected by the state constitution, namely the UUDNRI 1945 Article 28 and Law Number 9 of 1998 Article 1 Paragraph (1)
